Spirit of Madagascar – Private Tours & Local Guide Services

1. INTRODUCTION

These Terms & Conditions outline the agreement between Spirit of Madagascar (“we”, “us”, “the company”) and the traveler (“you”, “client”) for any tour, service, or product booked with us.
By confirming a tour, you accept these Terms & Conditions.

 

2. BOOKING & CONFIRMATION

2.1 How to Book

A booking is made when you:

  • Confirm your itinerary via email or message, and

  • Pay the required deposit (if applicable).

2.2 Deposit

To secure hotels, vehicles, guides, and activities, a deposit may be required depending on the tour type.
Deposits are typically 20% to 30% of the total price, up to 50%.

2.3 Final Payment

Full payment is required:

  • Before the tour begins, or

  • On Day 1 of the tour (cash or mobile payment, depending on location).

 

3. PRICES

3.1 What Prices Include

Prices include all services listed in the “Included” section of your itinerary.
All exclusions will be stated clearly.

3.2 Price Adjustments

Prices may change due to:

  • Fuel increases

  • Hotel changes

  • Seasonal changes

  • National park fee adjustments
    We will always inform you in advance before confirming the final price.

 

4. CANCELLATION POLICY

4.1 Cancellation by the Client

If you need to cancel:

  • More than 30 days before tour: full refund of deposit (minus bank charges)

  • 15–30 days before tour: 50% refund of deposit

  • Less than 15 days before tour: deposit is non-refundable

  • No-show: no refund

4.2 Cancellation by the Company

We may cancel a tour due to:

  • Extreme weather

  • Natural disasters

  • Political instability

  • Unexpected events outside our control

If we cancel, you will receive a full refund of all payments made, but we are not responsible for additional costs (flights, insurance, etc.).

5. CHANGES & FLEXIBILITY

5.1 Changes Requested by You

We will do our best to accommodate changes before or during the tour.
Additional costs may apply (hotels, fuel, domestic flights, etc.).

5.2 Changes Made by Us

If a service becomes unavailable (hotel, activity, etc.), we will replace it with an equal or higher-quality alternative.

6. TRAVEL INSURANCE

Travel insurance is strongly recommended.
It should cover:

  • Medical emergencies

  • Trip cancellations

  • Lost luggage

  • Travel delays

We are not responsible for incidents covered by travel insurance.

7. HEALTH, SAFETY & PERSONAL RESPONSIBILITY

7.1 Fitness & Health

You must be physically able to participate in the activities planned.
Please inform us of any medical conditions.

7.2 Safety During the Tour

You agree to follow the instructions of your guide.
We are not responsible for:

  • Accidents caused by personal negligence

  • Entering restricted or unsafe zones

  • Wildlife interactions not supervised by guides

 

8. LUGGAGE & PERSONAL BELONGINGS

We are not responsible for:

  • Loss, damage, or theft of personal belongings

  • Items left in hotels or vehicles

Keep valuables secure at all times.

9. LIABILITY

Spirit of Madagascar is not liable for:

  • Delays caused by weather, road conditions, strikes, or airline issues

  • Injuries, sickness, or accidents not directly caused by our negligence

  • Additional costs arising from unexpected events (road closures, flight delays, etc.)

 

10. CLIENT CONDUCT

We reserve the right to refuse service or terminate a tour if a client:

  • Behaves aggressively or disrespectfully

  • Endangers the safety of others

  • Breaks laws or park regulations

No refund will be issued in such cases.

11. PHOTOS & MEDIA CONSENT

During the tour, we may take photos or videos for marketing purposes.
If you prefer not to appear in photos, simply inform us at the start.

12. PRIVACY POLICY

Any personal information shared with us (names, passports, contacts) is kept confidential and used only for travel arrangements.

13. GOVERNING LAW

These Terms & Conditions are governed by the laws of Madagascar.
